Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and SpotDuel Gaming LLC ("SpotDuel", "we", "us"). They cover the SpotDuel website at spotduel.com, the SpotDuel mobile applications, and every challenge, contest and feature we offer (together, the "Service"). By creating an account, entering a challenge or otherwise using the Service you accept these Terms. If you do not accept them, do not use the Service.

You must be at least 18 years old, or the age of majority where you live, whichever is older. You must register with accurate information and may hold only one account. The Service is void where prohibited by law, and you are responsible for confirming that participation is lawful where you are.

Employees of SpotDuel, our sponsors and our prize suppliers, and members of their immediate households, may play but are not eligible to receive prizes.

SpotDuel challenges are always free to play and no purchase is necessary to participate. In a SpotDuel challenge the ball is removed from a real photograph and you judge, from the players' posture, sightlines, shadows and the action in the frame, where it should be.

Each challenge has one winning px point, fixed and recorded before entries open. Our operators measure the exact median pixel spot of the particular challenge image and lock it for the challenge. Images are only used once and will be removed after the challenge ends and the ball is revealed.

Your spots are measured in pixels from that median ball winning px point on the original image. The closest spot wins.

The official tie-break, applied in order, is:

• The entry whose closest spot is nearest the winning px point wins.
• If two or more entries are tied at the same distance, the second-closest spot placed by each tied player is compared, and the nearest of those wins.
• If they are still tied, the third-closest spot placed by each tied player is compared.
• If the entries remain tied, or a tied player has placed fewer spots, the entry submitted first wins.

Our measurements and records are final. Results may be verified, corrected or withheld while we investigate suspected error, fraud or abuse.

Prizes are described on each challenge before you enter. Prizes are personal to the winner, cannot be transferred, and cannot be exchanged for cash unless we state otherwise. We may substitute a prize of equal or greater value if the advertised prize becomes unavailable.

Winners are contacted using the email address on the account or the address given on the entry form. You may be asked to confirm your identity, age and eligibility before a prize is released. If a winner cannot be reached or does not respond within 30 days, or fails verification, the prize may be forfeited and awarded to the next eligible entry.

You are responsible for any taxes, duties or fees arising from a prize. Where the law requires it we may report prize values to tax authorities and request the information needed to do so.

SpotDollars, Tickets and Points are virtual items licensed to you for use inside the Service. They have no cash value, are not your property, cannot be redeemed for money and cannot be sold or transferred outside the Service. Balances may expire if an account is closed or inactive, and we may adjust the price, availability and reward value of virtual items at any time.

Purchases made through an app store are processed by that store under its own terms. Purchases of virtual items are final and non-refundable except where the law or the app store's policy requires a refund.

Keep your login details secure; you are responsible for activity on your account. You agree not to use bots, scripts, automated entry tools, image analysis tools, multiple or shared accounts, or any other method that gives an unfair advantage or interferes with the Service. You agree not to attempt to obtain the winning point of a challenge other than by playing.

We may suspend or close an account, void entries and withhold prizes if we reasonably believe these Terms have been broken.

Private challenges shared by link are run for the organiser who created them, and the details you enter are shared with that organiser so prizes can be awarded. Sponsored challenges are provided together with a brand partner; the sponsor is responsible for supplying the prize it offers, and its own terms may also apply.

The Service, its software, images, graphics and branding are owned by SpotDuel or our licensors and may not be copied, distributed or reused without permission. Team, league and sponsor marks remain the property of their owners. If you submit content to us, you grant us a non-exclusive licence to use it for operating and promoting the Service.

The SpotDuel mobile applications are distributed through the Apple App Store and Google Play. Apple Inc. and Google LLC are not sponsors of, and are in no way affiliated with, any SpotDuel challenge, contest or prize, and neither is responsible for operating the Service or awarding prizes. Any questions, complaints or claims about the Service should be directed to SpotDuel at support@spotduel.com, not to Apple or Google.

We may change, suspend or discontinue any part of the Service, including any challenge, at any time. The Service is provided "as is" and we do not warrant that it will be uninterrupted or error-free.

To the fullest extent permitted by law, SpotDuel is not liable for indirect, incidental or consequential losses, or for loss of virtual currency, entries or prizes caused by events outside our reasonable control. Nothing in these Terms limits liability that cannot be limited by law.

We may update these Terms. The date at the top shows when they were last changed, and continuing to use the Service after an update means you accept the revised Terms.
